Terms of use
English translation. The German version, Nutzungsbedingungen, is binding. If the two differ, the German version applies.
1. Provider and scope
These terms apply to the Rucksteady app on iOS and Android and to this website. The provider is Sebastian Nuss, Am Hochgericht 15, 55126 Mainz, Germany (see Impressum). For purchases through the App Store, these terms are the end-user licence agreement (EULA) referred to in section 10.
2. What Rucksteady is
Rucksteady is a training app for marching with a loaded pack. It is not medical advice, not a medical device and no substitute for a medical examination. The training plans are made for adults aged 18 or older. Before your first loaded ruck, read Health & safety.
3. Licence
You receive a simple, non-transferable right to use the app for personal, non-commercial purposes on devices you own or control, within the usage rules of the store you got it from. You may not rent, resell, reverse-engineer or modify the app, except where the law expressly allows it.
4. Free features and Premium
Recording, history, the health export, badges, the monthly challenge, share cards, the Learn articles and the 5 km plan are free. Every other plan and the live pacer are Premium, an auto-renewing subscription billed yearly or monthly that you buy through the App Store (Apple) or Google Play (Google); the yearly plan starts with a 7-day free trial. The store is your contracting party for the purchase and payment. Billing, renewal, cancellation, withdrawal, refunds and the free trial follow the terms of the store you bought from. You manage and cancel your subscription in your store account settings.
5. No pass guaranteed; standards change
No app can promise a pass. Rucksteady helps you prepare. Whether you pass depends on you, your health, the day, the route and the examiner. Plans, projections and the pacer are guidance, not a forecast of your result.
Each plan names the public source its numbers come from, as of the date shown. Armed forces and organisers can change distances, loads, time limits and rules at any time without telling us. Official requirements change; check the official source before your test.
6. Independence and trademarks
Rucksteady is an independent app. It is not affiliated with, endorsed by or sponsored by any armed force, authority or event organiser. Names of armed forces, units, tests, badges and events, such as the U.S. Army, the Bundeswehr, the KSK, the EIB, GORUCK, the Nijmegen Four Days Marches (Vierdaagse) or the Bataan Memorial Death March, may be trademarks or protected designations of their owners. We use them only to say which standard a plan prepares you for. Rucksteady uses no insignia, seals, badges or logos of these organisations. Military badges are awarded only by the armed forces, never by the app.
7. Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under product liability law, and where we have given a guarantee.
(2) For slightly negligent breach of an essential obligation, we are liable only for foreseeable damage typical for this kind of contract. Essential obligations are those that make proper performance of the contract possible and on which you may regularly rely.
(3) Otherwise we are not liable for slight negligence.
(4) Your statutory rights for defects in digital products remain unaffected.
(5) Ignoring the guidance under "Health & safety" may count as contributory fault.
8. Assumption of risk (users in the United States)
Rucking and loaded marching are physically demanding and carry inherent risks, including blisters, musculoskeletal and stress injuries, nerve compression, heat and cold illness, cardiac events, falls and traffic accidents. You choose your routes, loads, pace and conditions. To the fullest extent permitted by the law of your state, you voluntarily assume these inherent risks. This section does not limit our liability for gross negligence, wilful misconduct, or any liability that cannot be limited by law.
9. Availability and changes
We keep developing Rucksteady and may change features. We do not promise uninterrupted availability. We announce material changes to the app or to these terms in the release notes and on this page.
10. Additional terms for the App Store (Apple)
(1) These terms are between you and us, not with Apple Inc. ("Apple"). We alone are responsible for the app and its content.
(2) The licence in section 3 applies to Apple-branded devices you own or control, within the usage rules of the Apple Media Services Terms.
(3) We alone provide maintenance and support for the app (contact in section 12). Apple has no obligation to do so.
(4) If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the app. Any other claims, losses or costs from a failure to conform to a warranty are our responsibility.
(5) We, not Apple, are responsible for addressing any claims by you or a third party relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection law.
(6) If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
(7) You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
(8) When using the app, you comply with applicable third-party terms, such as those of your mobile network provider.
(9) Apple and its subsidiaries are third-party beneficiaries of these terms. On your acceptance, Apple has the right to enforce these terms against you as a third-party beneficiary.
For Google Play the same applies accordingly: Google is not a party to these terms.
11. Law and disputes
German law applies. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected. We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
